These Terms of Service ("Terms") govern your access to and use of the Website located at sobersince.ca (including any subdomains, the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

These Terms constitute a legally binding agreement between you and SoberSince Company. We may update these Terms from time to time, and your continued use of the Site after any changes constitutes acceptance of the updated Terms. The latest version will always be posted on the Site.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER.

We may terminate or suspend your access to the Site at any time, without notice, for any reason, including breach of these Terms. Upon termination, your right to use the Site ceases immediately. Sections surviving termination include Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the courts of Ontario, Canada. You agree to submit to the personal jurisdiction of these courts.

For disputes under $10,000 (excluding claims for injunctive relief), we agree to mandatory arbitration in Ontario under the rules of the ADR Institute of Canada. Class actions are waived.

12. Miscellaneous

  • Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and us.
  • Severability: If any provision is invalid, the remainder remains enforceable.
  • No Waiver: Our failure to enforce any right does not constitute a waiver.
  • Assignment: We may assign these Terms; you may not without our consent.
  • Force Majeure: We are not liable for delays due to events beyond our control (e.g., natural disasters, pandemics).
